In Maine, if you possess any drugs it is going to be a felony or misdemeanor, depending on the amount or type of drug. For example, a couple of grams of cocaine is just going to be a misdemeanor. But there a certain factors that the district attorney's office is going to look at to see if this constitutes trafficking in drugs, i.e. drug dealing.
If you have a large amount of drugs, if you have scales, and if you have large amounts of cash, it is more likely that you will be charged with trafficking. In every case, whether it is marijuana, cocaine, heroin, whatever the case may be, that will in fact be a felony trafficking case. It really depends on quantity, as well as the circumstances surrounding the arrest.
